Legal AI Platform Comparison: Verification Is the Product

Legal AI is judged on whether its citations are real, current, and correctly characterised. Evaluate verification against primary sources, jurisdiction and currency coverage, confidentiality and privilege handling, and a review workflow that a qualified person cannot skip. This is general guidance, not legal advice.

Legal AI Platform Comparison: Verification Is the Product article cover

Legal AI is judged on whether its citations are real and current. This guide covers evaluating it, drawing on FISTA Solutions' AI enablement governance work. This is general guidance, not legal advice.

What must be verified?

Six requirements before use on client matters.

RequirementWhat to verifyWhy it matters
Citation verificationLinks to primary sourcesFabrication risk
CurrencySuperseded material flaggedOutdated authority
Jurisdiction coverageYour jurisdictions, testedCoverage varies
ConfidentialityRetention, training, privilegeClient material
Review workflowCannot be skippedProfessional obligation

How should citations be verified?

By opening the primary source.

A platform linking each citation to the source, with a clear indication of currency, lets a reviewer verify quickly. One producing citations as text requires manual lookup, which consumes the time the tool was meant to save.

Test by taking a sample of outputs and checking every citation. The proportion that are real, current, and correctly characterised is the figure that matters. See AI content review checklist.

Why does currency matter as much as existence?

Because superseded authority is worse than no authority.

A citation to a case that has been overturned, or a statute that has been amended, reads as authoritative and is wrong. The platform should indicate currency and flag superseded material.

Test with authorities you know have changed recently. That is the sharpest test of currency handling available.

How does jurisdiction coverage vary?

Substantially, and claimed coverage is not the same as good coverage.

A platform with strong coverage in one jurisdiction may have thin, outdated, or secondary-source coverage of another. If you practise across jurisdictions, test each one you rely on.

Also check coverage of the specific practice areas you work in, since depth varies within a jurisdiction too.

What confidentiality handling is needed?

Explicit terms on retention, training, and privilege.

Client material is among the most sensitive data any organisation processes. What the platform sees, whether it is retained, whether it contributes to anything, and where processing occurs all need clear answers.

Whether privilege is preserved when material passes through a third-party system is a question for counsel rather than for engineering. This is general guidance, not legal advice. See AI subprocessor checklist.

What review workflow is required?

One a qualified person cannot skip.

Professional obligations remain with the person, not the tool. The workflow should require review before output is used, and record who reviewed what.

A platform making it easy to use output without review is creating a risk for its users. Check what the default path encourages. See why human oversight is a design problem.

Where is the lower-risk value?

In drafting, summarising, and reviewing rather than in research.

Summarising a long document, drafting a first version from a template, and extracting key terms from a contract all carry lower fabrication risk than legal research, because the source material is in front of the reviewer.

Those are frequently the better first deployments. See document AI platform comparison.

How do you run your own comparison?

Take twenty real research questions, run them, and verify every citation against the primary source. Record how many were real, current, and correctly characterised.

Then have counsel review the confidentiality and privilege position. Both are necessary before any client matter is involved.

What does switching cost later?

Low technically. The cost is workflow change and any accumulated research materials held in the platform.

Keep matter records and work product in your own systems.

What do people get wrong here?

Citations spot-checked rather than fully verified. Currency assumed. Jurisdiction coverage taken from a list. Confidentiality assessed internally. And a workflow where review can be skipped.

What about client disclosure?

Expectations vary and are developing. Some clients ask directly; some engagement terms address it.

Decide a position and apply it consistently rather than case by case, and take counsel on what your obligations are in your jurisdictions. This is general guidance, not legal advice.

Which should you choose?

Verify every citation in a real sample against primary sources, test jurisdiction and currency coverage for the areas you practise in, and require a review step that cannot be skipped. Start with drafting and summarising rather than research.

What should you do first?

Take twenty outputs and verify every citation. That single exercise tells you whether the platform is usable.

How FISTA Solutions helps

Clear answers

Questions raised by this field note.

Straightforward guidance for evaluating scope, fit, and the next step.

01What is the defining risk?

Citations that do not exist, have been superseded, or do not say what the output claims. This has produced professional consequences, and verification is the control.

02How should verification work?

Links to primary sources the reviewer can open, with currency indicated. A citation without a verifiable link is an assertion requiring manual checking, which removes much of the saving.

03Why does jurisdiction coverage matter?

Because law differs by jurisdiction and currency differs by source. A platform strong in one jurisdiction may have thin or outdated coverage of another you practise in.

04What confidentiality questions apply?

What the platform sees, whether it is retained, whether it trains anything, and whether privilege is preserved. Client material is among the most sensitive data any organisation holds.

05Does responsibility transfer?

No. Professional obligations remain with the qualified person regardless of what tool produced the draft. The review step is not optional. This is general guidance, not legal advice.
